Right to Legal Counsel if Arrested
You have been formally arrested after a serious accident on the highway. You are at the station, shaken, with officers asking you to give a statement.
If you are formally arrested (which is rare for traffic matters), you have the right to consult and be defended by a lawyer of your choice immediately after arrest. Police must inform you of this right.
Do not give any statement before speaking to your lawyer. Police must inform you of this right — if they do not, remind them.
"I wish to consult my lawyer before answering any questions. This is my right under Constitution Art. 22(1) and BNSS s.41D."
